Codacons on Alitalia: the authorisation law for the sale of Alitalia is unconstitutional

(WAPA) - A press release by the Codacons stated yesterday that the law on the basis of which the sale of Alitalia was authorised is unconstitutional. Codacons today affirmed their reasons in front of the Lazio administrative tribunal, the same one in which the suspension of the recourse related proposed programme was made. The judges will decide with an ordinance that will be made public tomorrow. The decree with which minister Scajola, on November 19, 2008, authorised the sale of Alitalia to CAI, according to the program proposed by the extraordinary Commissioner of the airline, Augusto Fantozzi, was contested.
Gino Giuliano was the lawyer speaking on behalf of the Codacons. "The first section of the Tar last May 27 already raised questions about the constitutionality of the rule that, with reference to the operations of concentration between companies, as in case of Alitalia, it was taking them away from the authorisation of the Antitrust. Today we have insisted to hang the judgement with the remission of the acts to the Supreme court to evaluate a further question about constitutionality: the one referred to the decree that has authorised the program of sale of the company. We are confident that the judges may satisfy our requests". (Avionews)
