Tar on Alitalia: the "Legge Scajola" will not be taken to Constitutional Court

Rome, Italy - The appeal of the Codacons was rejected by the III Section of the administrative court of the Lazio Region

(WAPA) - Following today's decision of the administrative court of the Lazio Region, the Constitutional Court will not have to pronounce itself about the constitutional legitimacy of the law thanks to which the Alitalia sale programme has been authorised.

The decision of the III Section ter of the administrative court of the Lazio Region, chaired by Italo Riggio, has therefore rejected the request made by Codacons. The reason of the judges' denial is the fact that the present measure, the authorisation by minister Scajola to the extraordinary commissioner of Alitalia, Augusto Fantozzi, to proceed with the sale of Alitalia, has already led to its consequences.

For chronicle duties, it is necessary to add that there already exists a constitutional question raised by the first Section of the TAR of Lazio on 27th May, and its result is awaited. See also AVIONEWS. (Avionews)
