Antitrust. Fine to Ryanair for over 1.8 million euros

For massive cancellation of flights September-October 2017

We receive by the Antitrust and publish it, leaving the same opportunity for possible replies:

"The Antitrust Authority has closed the preliminary investigation against the Irish carrier Ryanair in September 2017, ascertaining, as an unfair commercial practice, the fact that numerous cancellations of flights have been carried out due largely to organizational and management reasons already known to the airline -not dependent on occasional and exogenous causes outside its control-, provoking considerable inconvenience to consumers who had long planned their travels and already booked and paid for the relevant ticket.

To this is added the found misleading in the ways in which the carrier informed the passengers of the cancellation of the flights, since it proposed them two possible solutions (refund or ticket change) without adequately informing them of the existence of their (further) right to pecuniary compensation -if due- provided by Regulation CE 261/04 precisely in the event of cancellation of flights.

During the investigation, Ryanair, effective from February 2018, in compliance with the Authority's order in the precautionary measure decided in October 2017, changed its conduct, updating the information on its website, specifically in relation to the right to pecuniary compensation, as well as sending individual communications to interested consumers who have enabled them to fully understand all the rights due to them following the cancellation of flights and, consequently, to exercise them.

In consideration of this, the Authority adequately reduced the amount of the pecuniary administrative sanction imposed on the airline in the main proceedings, setting it at € 1,850,000, and decided to terminate the non-compliance procedure, without imposing any fine on the carrier".
